My children are born citizens of the USA. We want to move to the Philippines. Can they claim Philippine citizenship as a dual passport because I’m a Filipino by birth?

    I do not know if American laws allow dual citizenship of natural born American citizens. We must clarify first your citizenship standing in the Philippines. A Filipino by birth does not necessarily mean that you are a Filipino citizen. It is required under the Philippine laws that you are borne to Filipino parent(s) wherever they are situated. In this instance, where one of the parents is a Filipino citizen at the time of your birth, the child at maturity may elect his/her citizenship of either parents. To elect the Filipino citizen, you may arrange yourself to visit the Philippine Consulate of your place. The principle of jus sanguinis ie parents are Filipino citizen(s) is the policy adopted by the Philippine government to be a Filipino citizen by birth. The principle of jus solis, ie citizenship by birth will not apply to children born in the Philippines to foreign parents to be a Filipino citizen by birth.

    You can impart them the citizenship through re-acquisition thus making you and your minor kids become dual citizens but only kids under 18 qualify for this.
