Can a US citizen build and own a house in the Philippines together with their Philippine citizen spouse?

    You can both build a house, and the house can be legally in both names. The land is sometimes put on both names, but the legality is that ‘normally’ only a Filipino can own the land. This is embodied in Section 7, Article XII of the 1987 Constitution, which is basically a reproduction of Section 5, Article XIII of the 1935 Constitution, and Section 14, Article XIV of the 1973 Constitution.Ownership of Philippine Land by a Foreigner A foreigner can buy land, but that transaction can be declared invalid by the Supreme Court.To avoid that, the foreigner must transfer the land to a Philippine citizen. I knew of a couple who had bought a house and land together, but when they split up, the Filipina refused to sell the land. The US citizen had to wait until she changed her mind, before he could get at his share of the house. It was ongoing for 5 years when I heard about it. No idea if it was ever resolved.

    Of course they can, as long as you are married to a Filipina the two of you can buy land and build a house.
