As long as the two are not of the same gender, a man and a woman – one being Indian and the other of a foreign nationality can absolutely marry under Indian law. This also includes transgender people. This is guaranteed by the Indian Marriage Act. As far as the citizenship of the people involved is concerned, the Indian party does not have any effect on their citizenship and the foreigner party gets to choose whether or not they want to get Indian Citizenship, but they do not automatically become Indian citizens as a result of the said marriage. The foreigner party can apply for Indian Citizenship after proving they have lived in India for at least a period of 1 year.
