Yes he could and more than likely nothing scandalous would occur. However he would be committing concubinage which is against law in the Philippines whether he is married to a Filipina or another Nationality. Now if his current wife was feeling vindictive she could travel to the Philippines and could try to have him arrested for concubinage. She might be successful maybe not. If she was he would find himself probably being deported and barred from reentry. Another issue would be if his mistress is married to a Filipino. Since there is no divorce available to most Filipinos and if her husband is feeling vindictive then he can have the expat arrested for adultery, try to extort money, or even exact some revenge by bolo. None of these would be beneficial to the expat. This is a common occurrence in the Philippines whether one of the couple is an expat or not and normally nothing happens but that does not mean that nothing could happen.

No. Since she is a mistress, means they are not married, and thereby would not give any leverage to the expat to acquire reaidency in the Philippines.
